Dispute Resolution Policy
At GigTaps, we aim to provide a safe, fair, and transparent platform for both freelancers and clients. While most projects are completed smoothly, we understand that disputes may occasionally arise. This policy outlines how disputes are managed and resolved on GigTaps.
1. Definition of a Dispute
A “Dispute” occurs when:
-
A client is dissatisfied with the quality of work delivered.
-
A freelancer believes they have not been paid fairly for completed work.
-
Either party alleges a breach of GigTaps Terms & Conditions.
2. Initial Resolution (Between Client & Freelancer)
-
We encourage direct communication first.
-
Both parties should attempt to resolve the issue through the project’s chat or agreed communication channel.
-
Clear evidence (messages, work files, agreements) should be documented.
3. Filing a Dispute with GigTaps
If the parties cannot resolve the issue within 5 days, either may file a formal dispute through the platform.
-
Disputes must include supporting evidence (screenshots, contracts, milestones, etc.).
-
A GigTaps Dispute Specialist will review the case.
4. GigTaps Mediation Process
-
Step 1: Review – Our team reviews evidence provided by both parties.
-
Step 2: Mediation – We facilitate communication to reach a fair compromise.
-
Step 3: Decision – If no agreement is reached, GigTaps will make a final decision based on:
-
The original project agreement.
-
Proof of work delivered.
-
Payment terms agreed upon.
-
5. Possible Outcomes
-
Refund: Client may receive a full or partial refund.
-
Release of Payment: Freelancer may receive full or partial payment.
-
Split Settlement: Payment may be divided between both parties.
6. Binding Nature of Decisions
All GigTaps dispute resolution decisions are final and binding within the platform. Parties retain the right to seek external legal remedies, but GigTaps’ decision governs all transactions handled within our system.
7. Fees
-
Filing a dispute is free for now (as a startup benefit).
-
In the future, a small dispute handling fee may be applied to discourage frivolous claims.
8. Escalation Beyond GigTaps
If a party is still unsatisfied, they may seek:
-
Arbitration in accordance with Lagos, Nigeria.
-
Court proceedings under applicable law.
